These Terms of Service ("Terms") govern your access to and use of the RideDesk web application and Chrome extension (the "Service"), operated by ElevateCode LLC("we", "us"). By creating an account or using the Service you agree to these Terms.
1. The Service
RideDesk is a booking and dispatch platform for taxi, limousine, and chauffeur operators. You may use it to manage bookings, drivers, vehicles, customers, and to accept booking requests from the public.
2. Accounts
- You must be at least 18 and legally able to enter into contracts.
- You are responsible for the accuracy of registration information and for all activity under your account.
- Keep credentials confidential. Notify us immediately of any unauthorized use.
3. Trial and subscription
New workspaces include a 30-day free trial. After the trial, continued use requires an active paid subscription. Pricing and plan details are shown in the Service. If a subscription is not activated after the trial, the workspace enters read-only mode until a plan is chosen.
4. Acceptable use
- Do not use the Service to violate laws or third-party rights.
- Do not attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service.
- Do not upload malware or use the Service to send spam or unsolicited messages.
- Do not use the Service to store sensitive categories of data (e.g. payment card data, health data) beyond what is required for basic booking operations.
5. Your data
You retain ownership of the data you and your customers submit ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide the Service. Your handling of passenger data must comply with applicable privacy laws.
6. Service availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or modify features at any time.
7. Fees and payment
Subscription fees are billed in advance on a recurring basis until cancelled. You are responsible for applicable taxes. Refunds are governed by our Refund Policy.
8. Termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms or use the Service in a way that risks harm to other users or third parties.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, ElevateCode LLC's total liability arising out of or related to these Terms will not exceed the amount you paid us for the Service in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which ElevateCode LLC is registered, without regard to conflict-of-law principles.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date. Continued use of the Service after changes take effect constitutes acceptance.
